Terms and Conditions for OneLight Artistry

Purpose The Client engages OneLight Artistry ("Artist") to provide hair services ("Services") on the agreed date and time at a location determined by the Client. The final list of services will be reflected on the final invoice. The Artist will perform these Services for the Client and any other individuals ("Attendants") included in this Contract under the Terms and Conditions outlined. This Agreement establishes an independent service provider relationship, not an employer-employee relationship, between the Artist and the Client.

Client’s Obligations

The Client agrees to pay all rates and fees as per the Payment section.

The Client is responsible for travel, accommodation, toll, and parking fees as stated in the Travel/Accommodation section.

The Client must collect payments from all Attendants receiving services. The Client assumes responsibility for any unpaid fees, regardless of personal arrangements with Attendants.

Clients and Attendants must provide advance written notice of any allergies or conditions as per the Liabilities section.

The Client must ensure a safe and suitable workspace, including appropriate lighting, electrical outlets, and a setup table. Failure to provide this may affect service quality, for which the Artist is not liable.

The Artist is not liable for injuries occurring on location.

Artist’s Obligations

The Artist will perform Services with skill, care, and diligence at the agreed location, date, and time.

The Artist will use their own products unless otherwise agreed. Sanitary practices will be followed.

If the Artist cannot perform the Services due to unforeseeable circumstances, they will arrange for a qualified replacement under the same payment terms.

The Artist may subcontract additional stylists/assistants for large bookings to ensure timely service.

All intellectual property developed under this Agreement remains the property of the Artist. The Client is granted a limited-use license for images, videos, and social media content upon request.

Bookings
-
A start and end time will be scheduled. Each service requires a minimum time, and additional services are at the Artist’s discretion.

All individuals must be available at the scheduled appointment time. Services for more than one person must be at the same location.

An assistant may be required for bookings of four or more people. The Artist will only guarantee services for those included in the contract. Additional services may be performed at the Artist's discretion if time permits, at an extra cost.

A non-refundable but transferable deposit is required to reserve the date and time. Services are reserved only upon receiving a signed contract and deposit with proof of payment.

Payment

The final balance is due before services are provided via e-transfer or cash. The Client is responsible for the full balance.

Accepted payment methods are e-transfer or cash.

Deposit
-
A 50% non-refundable deposit is required upon signing this Agreement to reserve the date. This amount will be credited towards the Client's total service cost. The remaining balance is due before services begin.

Cancellations

The Artist reserves the right to terminate this contract for any breach of terms. Canceled appointments will not receive a refund on deposits.

If the Artist cancels the Agreement for reasons other than breach, or cannot provide the Services and cannot find a replacement, the deposit will be refunded within two weeks. The Client agrees that a 100% refund of the deposit is the only liability of the Artist.

The Artist is not liable for service cancellations due to illness, accidents, acts of God, or other events beyond their control.

Travel/Accommodation

Travel fees will be indicated on the Client's invoice, determined based on distance from the Artist's location.

The Client is responsible for all travel expenses, including but not limited to airfare, hotel, transportation, parking, and toll fees.

Limitation on Liability

The Client agrees to indemnify OneLight Artistry for any claims, losses, damages, or injuries resulting from the Artist’s performance or other related reasons.

The Artist maintains sanitary practices, including sanitizing tools and products between uses. Clients should report any allergies or conditions in advance. The Artist is not liable for allergic reactions.

If serious conditions are identified, the Artist may discontinue services due to hygiene concerns.

Dispute Resolution

Any disputes arising from this Agreement should first attempt to be resolved through negotiation. If unresolved, disputes will proceed to Alternative Dispute Resolution in accordance with the rules of the British Columbia International Commercial Arbitration Centre, located in Vancouver, British Columbia, Canada, unless otherwise agreed by the parties.
